FFCobra.com LEGAL DEFENSE FUND - UPDATE 3/11
Updated, posted 3/11/2009
We received another bill today from our lawyers in the amount of $7,900.
I'm going to try and find a lawyer in MA this week.
Thanks for all the help with the legal fees.
Bill

Updated, posted 2/23/2009
The Federal Judge in California agreed to transfer the case to Massachusetts.
Thank you everyone who has been helping with out legal costs.
Thanks,
Bill

Below, posted 1/20/2009
As many of you know, FFCobra.com, along with Factory Five and one of their dealers, has been sued by Carroll Shelby, Shelby Trust and Shelby Licensing. You can read the complaint filed by clicking here. Please refrain from making any derogatory comments on the forum about anyone involved in this matter and try not to give Shelby any ammunition in this case.
I'm confident that we will prevail, but it's going to cost money to fight and that's why I need your help. I know times are tough and I didn't want to have to get any help, but the first legal bill arrived last week and it was $5,000. This is the first of many monthly bills to come.
This site is not a big money maker. I have a real job and this site is just a hobby. The only way I’m able to keep this site running is because of the help of our great moderators, generous supporting members, wonderful advertisers, and members like you. Without all of this synergy, this site would be nothing.
Because of Shelby's actions, Factory Five's lawyers felt it was prudent for FFR to pull their ads. They didn’t pay December or January’s bill and now we have the legal bill to pay. This is why I'm asking for some help.
You can make a donation by PayPal by clicking here: https://www.paypal.com/cgi-bin/webscr?cmd=_s-xclick&hosted_button_id=2647148
If you want to send a check, please mail it to:
Bill Peirce
3939 Royal Drive NW, Suite 139
Kennesaw, GA 30144
Please tell everyone you know about this and post this link to any discussion forum you can think of. People who use forums should support this cause because if Shelby prevails, it might affect many, many other people and forums.
Thanks!
- Bill

Wow
WOW,
I am sending $. This is important, I encourage folks to go big if you can.
The irony is we are the same people that make all those trademarks so valuable! If we go away he looses serious value, and fans.....
It is interesting how much the lawsuit speaks of the "coupe".

not much, but I gave what I could
I've wanted to build a FFR since the mid 90's. I have one of the first assembly manuals. I've always thought what they do is great. I decided a roadster was too impractical for the mostly highway driving I do, as it is just too dang hot in Texas most of the time. And, I have an expensive Boss 302 T/A clone in the garage. But I still dream of building one, or a coupe.
Regardless, I don't come to visit here much. But this is important. That greedy ol SOB should be ashamed of himself.
And you may just have to redesign the website to say FFRracing.com or something.
I guess this is the change Obama was talking about........

Yes Bill, I will send money.
I also suggest that we get all those FFR members who have a Shelby signed dash and or glove boxes to take a picture of them and e-mail them to Factory Five and ffcobra.com along with whatever info they have about it. Anyone have a Factory Five or FFCobra.com shirt signed by Shelby, that would be good.
I am trying to be very careful about not making disparaging remarks here. The following is fact. Many of us have been to such events where "signings" are being done, like at at the California Speedway. I can't possibly see how Mr. Shelby can claim that he didn't know exactly whose "cobra replicas" those dash boards belonged to that he was personally signing his name to (exactly the same "authentication" he places on his "Shelby" cars).
I think it would be a difficult sell to now claim that one thought all those FFR roadster owners were "Shelby Cobra" owners, and who just decided to rip the dash out of their $500,000+ cars to get Mr. Shelby's signature on them. But, wait a minute, "Shelby Cobras" already came with his signature on them. At any rate it will make very interesting listening to hear an explanation of that decade's long brain fart to the jury.

You'll have what little I can spare. This is ridiculous. I will refrain from making comment about you-know-who as I hope everyone else will. But to say that these cars devalue or diminish the originals is ludicrous, especially the coupe. If it wasn't for replicas no one under 40 would even know what these cars were. They would be a footnote in history, left in the 60's where they were great. Only a memory in the minds of old farts like me and some of you. Do they really think we'd be talking about these cars 40 years later if there had been no replicas? It's like they say "what have you done for me LATELY, baby".
And what are they thinking of by going after the forum??? That is VERY disturbing.
Money sent. Please remind me monthly until this is done.

I wonder if he'll sue the Big Guy too?
"Excuse me, Mr. God, Sir? We're suing you because your venomous reptile de-values Mr. Shelby's car. You're expected in court in two weeks. Good day Sir"
I know the economy is in rough shape, but why stoop to such low levels to earn another buck?
I'll donate what I can.

Hmmm...a lot of stuff regarding meta tags...etc. How about factoryfiveforums.com...or something like that ? It is available right now and you could start doing a redirect immediately pending this case.
I think Shelby's attorneys are being pretty petty about this (I'd be surprised if CS even knows about it)... I have some experience regarding this type of stuff and have to ask if they ever sent a cease and desist letter or any type of warning?
I can understand some of their complaints towards FF maybe....but FFCobra.com? That's pushing things.

I've never posted, mostly because I dont own an FFR or any other kit, but I hope to one day. It boils down to a simple case of greed, plain and simple and I dont think this is the first time he has pulled a stunt like this. Sad really - If I were him I'd take it as an honor that so many people wanted to be part of the history I created. I'm pretty poor to be honest, but I will try to help as well.

Bill, we have some money left over in the FFR Pizza fund. Not enough to send another lunch to them and I haven't started collecting more. Why don't I send you that, plus my own. I'm sure FFRs employees wouldn't mind skipping one starchy meal to help save their jobs...
I think there's about $350 in there right now. Please advise.

Bill,
I tried logging in through the link you posted and it would not let me log in. I logged in fine through the paypal.com page. You might want to check that out.
UPDATE---I filled in the amount before logging in and that made the link work. Sorry for any confusion.

Sending what I can via paypal.
Bill, as a fellow web developer you may want to get a new URL one with out xxxxx in it. To migrate the database over shouldn't be too hard this site could then be a redirect to the new one. Then make the word about the snake a censored word, and I believe you would be removed from culpability but I am no lawyer. Sorry it came to this. Good Luck!

You are welcome to use the name 'watermoccasin' instead of 'co***' if you'd like and I'll sign whatever documents needed to alalow you full use of the 'wm' trademark without compensation ;-)
